1. About These Terms

These Terms govern your use of Flight Briefing, the aviation weather and information app operated by Morz Group (Pty) Ltd. The App is intended for users in South Africa and is available through the relevant Morz Group website and supported app stores. No account is required.

By using the App, you agree to these Terms. Our Privacy Policy forms part of these Terms.

IMPORTANT: Please read sections 5 and 12 carefully before using or relying on the App. They contain aviation-safety and liability provisions.

3. South African Law and Consumer Rights

These Terms are governed by South African law. In these Terms, CPA means the Consumer Protection Act 68 of 2008, ECTA means the Electronic Communications and Transactions Act 25 of 2002, and POPIA means the Protection of Personal Information Act 4 of 2013.

Nothing in these Terms excludes, restricts or waives a right or remedy that cannot lawfully be excluded under the CPA, ECTA or other applicable South African law.

4. What Flight Briefing Does

Flight Briefing is a free aviation tool that retrieves weather information and NOTAMs to support situational awareness. With your permission, it may use your device location.

5. Critical Aviation Safety Notice

FLIGHT BRIEFING IS NOT AN OFFICIAL PRE-FLIGHT BRIEFING AND MUST NOT BE USED AS THE SOLE BASIS FOR AN OPERATIONAL FLIGHT DECISION.

Weather data, METARs, TAFs, NOTAMs and other information are obtained from third parties and may be delayed, incomplete, unavailable or inaccurate because of source-data errors, connectivity failures, API outages or other causes outside our control.

Do not rely on the App alone for a go/no-go decision, route selection, fuel planning, alternate selection or any other operational decision. Before flight, verify all relevant information using current official and authoritative sources required for your operation, including applicable SACAA and aeronautical-information sources.

6. Third-Party Aviation Data

The App uses aviationweather.gov as a source for weather and NOTAM information. Morz Group is not affiliated with aviationweather.gov and does not control its availability, accuracy or completeness.

7. Location

The App may request device-location permission to identify the geographic area for a query. Location coordinates are sent from your device to aviationweather.gov and are not stored on Morz Group servers. You may deny or revoke location permission; automatic location-based functions will then be unavailable.

8. Intellectual Property and Licence

The App, its software, design and branding are owned by or licensed to Morz Group (Pty) Ltd. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for its intended informational purpose.

You may not copy, modify, distribute, sell, scrape, reverse-engineer or circumvent technical protections except to the extent applicable law expressly permits.

9. App Stores and Third-Party Terms

If you obtain the App from an app store, the store’s applicable terms and standard licence terms also apply to your relationship with that store. Morz Group remains responsible for the App to the extent required by applicable law and the relevant store arrangements.

If you obtain the App from Apple’s App Store, Apple’s standard end-user licence agreement applies unless a custom licence agreement has been provided for the App. Other applicable app-store terms may also apply to your relationship with the relevant store.

10. Prohibited Use

You may not use the App unlawfully; interfere with its operation or infrastructure; attempt unauthorised access; introduce malicious code; or use automated means to scrape or systematically extract content or data, except where applicable law permits.

11. Availability and Changes

We may update, change, suspend or discontinue the App or a feature.

12. Important Liability Notice

This section limits our liability and must be read together with the aviation-safety notice above.

The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by South African law, we do not warrant uninterrupted availability or the accuracy, completeness or currency of third-party aviation data, and we exclude liability for indirect or consequential loss arising from use of or inability to use the App.

We do not exclude or limit liability where doing so is prohibited by law, including liability that cannot be excluded under the CPA. Nothing in these Terms limits any mandatory right to quality service or other statutory remedy.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or website where reasonably practical. Where the law requires fresh acceptance, we will obtain it.

14. Complaints and Disputes

Please contact info@morzgroup.com first so that we can try to resolve a complaint. You remain free to use any statutory consumer, regulatory, ombud, tribunal or court process available under South African law. South African courts have jurisdiction, subject to mandatory jurisdiction rules.

15. General

Severability. If a provision is invalid or unenforceable, it will be severed or limited only to the extent necessary, without affecting the remainder.

No waiver. A failure to enforce a provision is not a waiver of that provision.

Language. The English version is the operative version.
