Use of Products and Services

You may only use the products and services for their intended use and shall not use the them for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. These products, services and the content provided by them may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. ‘Deep-linking’, ‘embedding’ or using analogous technology is strictly prohibited. Unauthorized use of the products, services and/or the materials contained in them may violate applicable copyright, trademark or other intellectual property laws or other laws.

Our products and services are licensed to a single human-user per purchase. We do not allow accounts to be shared. Each individual person who requires access to a product or service must create their own account and purchase the relevant product(s) or service(s). We reserve the right to implement access control policies that restrict access to only one user per account at a time.

Disclaimer of Warranty

The contents of our products and services are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement.

The owner and the authors of the contents and in general anybody connected to the products and services in any way, assume no responsibility for errors or omissions in their contents.

We further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of the products or services, not their contents. We shall not be liable for any direct, indirect, general, special, incidental or consequential damages (including -without limitation- data loss, lost revenues and lost profit) which may result from the inability to use or the correct or incorrect use, abuse, or misuse of these products, services or their contents, even if we have been informed of the possibilities of such damages. We cannot assume any obligation or responsibility.

Refunds

Our policy lasts 7 days due to the nature of the products, services and their content. If 7 days have gone by since your purchase, unfortunately we cannot offer you a refund or exchange as this can lead to abuse. Refunds are only offered when no use of the product or service purchased has taken place. Due to abuse, we unfortunately we can’t offer you a refund or exchange on a purchase where it’s product or service has already been used. When processing refunds, a service fee may be charged.

Disputes

Should there be a dispute regarding a product or service, your access to it may be suspended pending the outcome of the dispute.

The use of our products or services is at the your sole responsibility and risk. We expressly disclaim any warranty with respect to the information on the products or services including its accuracy, completeness, reliability, quality, fitness for a particular purpose, representation of technology or regulation. It is always the responsibility of the user to verify the accuracy of any information before using such information, including, but not limited to the purposes of flight planning and navigation.

Purchasing of products or services does not entity you to support on them, unless the support is of a technical nature to do with accessing your purchase. We will try to provide other support such as answering questions about exams or courses, but this is on a “best-effort” basis and we make no guarantee of the time for a reply, or even if one will be returned. If you need help on understanding content or answering questions, please speak to your flight instructor.

The use of our products or services is forbidden in those places where the law does not allow this disclaimer to take full effect.

Our Rights

We reserve the right to:

• modify or withdraw, temporarily or permanently, the products or services (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of any products or services; and/or
• change these Terms and Conditions and/or Privacy Policy from time to time, and your continued use of the products or services (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions and/or Privacy Policy has been changed. If you do not agree to any change to the Terms and Conditions or Privacy Policy then you must immediately stop using our products or services.
• We will use our reasonable endeavour to maintain the products and services. The products and services are subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of a product or service or because of a failure, suspension or withdrawal of all or part of a product or service due to circumstances beyond our control.

Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the products or services. We may investigate any reported violation of these Terms and Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the products or services).

Law

The Privacy Policy and Terms and Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa whose courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

Updating of these Terms and Conditions

We reserve the right to change, modify, add to or remove from portions or the whole of the Privacy Policy or these Terms and Conditions from time to time. Changes will become effective upon such changes being posted to this website. It is the user’s obligation to periodically check the Privacy Policy and these Terms and Conditions on the website for changes or updates. Your continued use of the products or services following the posting of changes or updates will be considered notice your acceptance to abide by and be bound by the Privacy Policy and Terms and Conditions, including such changes or updates.

Copyright

You undertake not to copy/duplicate the trademarks, designs or content of Morz Group (Pty) Ltd. directly or indirectly in any way and understand the legal implications thereof. Should you be found to be in violation of this agreement you understand that you will be held liable for all legal costs incurred by Morz Group (Pty) Ltd for any civil action and/or any legal action deemed necessary against you.

Account Deletion

We allow you to completely remove your account with us. Please note that if we are required to keep certain information for legal purposes, such as a record of purchases for tax reasons, we will still keep this. However, any information not required will be deleted. This is not a soft-delete, so if you do delete your account, you will lose access to any subscriptions that were activated and there is no way for us to recover that access or any other details related to your account such as your usage history. To delete your account, go to the “My Account” page and scroll to the bottom. We do not allow account deletions through the contact form. As we only store the email address of users for authentication purposes this would allow malicious users to request the account deletion of other users.

If you have created a user account on our website, but not purchased anything for 1 month, we reserve the right to remove your account without warning or notifying you thereof. If you have purchased something, this extends to 1 year from the date of purchase. This does not guarantee that we will remove your account within that time, only that we reserve the right to, and the actual time may be later.
